Legal Counsel - Construction and Operation of RES Projects

Twój zakres obowiązków

• Drafting, reviewing and negotiating construction and supply contracts for wind farms, PV farms and energy storage: EPC, BOP, turbine supply agreements (TSA) and module and battery supply agreements, including contracts based on FIDIC conditions
• Supporting contract management during construction: variations, delays, extensions of time, liquidated damages, performance tests, taking-over and the defects notification period
• Handling claims and disputes with contractors and suppliers
• Advising on performance guarantees, parent company guarantees, statutory warranty (rękojmia) and quality guarantees
• Advising on construction law: building permits, commencement and completion of works, occupancy permits, and dealings with building supervision authorities
• Drafting, reviewing and negotiating O&M agreements, service agreements, BESS service agreements and asset management agreements
• Day-to-day support for the O&M team: availability and performance guarantees, warranty claims, oversight of contractors, termination of agreements and replacement of service providers
• Handling assigned matters independently and reporting to the Head of Legal
• Taking part in transactions and negotiations in Lithuania together with the local legal team
• Developing and updating the Group’s contract templates and negotiating positions for construction and O&M agreements
• Identifying legal and contractual risks and proposing practical solutions

Nasze wymagania

• Qualified as a legal adviser (radca prawny) or advocate (adwokat)
• At least 8 years of experience in a law firm or an in-house legal department, specialising in support for the construction and operation of renewable energy projects
• Proven achievements that confirm your qualifications, such as negotiated EPC, BOP or O&M contracts, renewable energy projects taken through to COD or claims and disputes handled successfully
• Practical knowledge of FIDIC conditions of contract
• Very good knowledge of construction and civil law
• Ability to work independently and make decisions on assigned matters (essential requirement)
• Very good written and spoken English as contracts and negotiations are conducted in English
• Clear, practical communication and good business understanding
